HIPAA Privacy and Security for Employers

Many employers do not understand the full scope of compliance required by the HIPAA Privacy and Security rules. Many employers mistakenly believe that their plans are not subject to HIPAA because they are fully insured, or that employee training is the only thing they need to worry about. To comply with HIPAA, most employers should have written HIPAA policies in place that govern the plan’s use of Protected Health Information (PHI). Employers must also comply with a number of other HIPAA requirements, including: entering into written agreements with Business Associates, implementing safeguards to secure PHI, and conducting a Security Risk Assessment, to name just a few.
The Department of Health and Human Services (HHS) investigates thousands of HIPAA privacy and security complaints every year and is also currently conducting its second round of random HIPAA audits. IRS §4980H Penalty Collection Efforts and Why Employer Reporting Still Matters

The IRS has begun to send letters to employers (Letter 226J) to begin the collection process for those who failed to meet the §4980H requirements for benefits offered during 2015. Penalty calculations are based on data provided by employers to the IRS on Forms 1094-C and 1095-C. Many of the IRS proposed employer penalties are due to mistakes made in employer reporting, not to an actual violation of a §4980H requirement. This webinar will review the 4980H rules and employer reporting requirements. We will also explain the IRS penalty assessment dispute and collection process and help employers understand how to respond to an IRS proposed assessment.

The Future of Wellness Plans After the AARP v. EEOC Decision

In a suit brought by the American Association of Retired Persons (AARP), the U.S. District Court for the District of Columbia ruled against the Equal Employment Opportunity Commission (EEOC) saying that portions of the EEOC’s final wellness regulations related to wellness incentives were arbitrary. The court ordered the EEOC to review the rules and make changes to satisfy the court. Although the current ruling does not change anything immediately, it raises questions about how employers will handle their wellness plans in the future. This webinar will review current EEOC regulations and the existing HIPAA wellness rules, and it will help employers think about how to prepare for changes that may be made to the EEOC rules as a result of the AARP case.

ACA 1094/1095 Employer Reporting Year 3 (and possible changes to the ACA)

As you all know by now, as of the middle of September, that has not happened. OCR Begins New Phase of HIPAA Audits

As a part of its continued efforts to assess compliance with the HIPAA Privacy, Security and Breach Notification Rules, the Department of Health and Human Services Office for Civil Rights (OCR) has begun its second phase of audits of covered entities and their business associates. OCR has stated that they will be auditing all types of covered entities, including employer sponsored health plans. There is a tremendous amount of confusion around what it means for an employer’s plan to be “affordable” under the ACA. It’s not surprising because there are two different kinds of affordable criteria. First there is the definition of when an employer’s plan is affordable for purposes of an individual who is purchasing individual health insurance and trying to qualify for a subsidy. Separately, there are the three employer affordability safe harbors provided by the IRS to help employers set contribution rates in a manner that mitigates their §4980H(b) penalty risk. IRS §414 Controlled Group and Affiliated Service Group Rules

Internal Revenue Code §414 controlled group and affiliated service group rules require some separate companies to be treated as a single employer for purposes of several different benefits related issues including: 401k administration, discrimination testing, and ACA Applicable Large Employer (ALE) status for health benefits. Employers with certain levels of common ownership and/or operational integration must determine their single employer status under these rules, even if they have separate tax EINs. For the first time, beginning in 2016, employers will need to apply these rules in IRS reporting if they are part of an “aggregated group” of employers when they complete their Form 1094. This webinar will help employers understand the basics of the §414 rules and in some cases determine if they are part of an aggregated group. At a minimum, employers will understand if they need additional employer-specific analysis to make the determination.

Full-Time Employees & the ACA Employer Shared Responsibility Final Regulations

In February, the IRS released final regulations regarding the ACA 4980H employer shared responsibility rules. The final regulations contained a number of clarifications, and some new information, in regard to determining full-time employee status. This webinar goes into detail on new information in the final regulations related to how employers need to define their full-time employees for purposes of the 4980H rules.
This webinar will focus on issues of particular importance to employers who are considered “applicable large employers.” Small employers are not required to comply with the ACA employer shared responsibility rules and enforcement for employers with 50-99 FTEs has been delayed until 2016.

Calculating the ACA PCORI & Reinsurance Fees

Some employers will be paying the ACA Patient-Centered Outcomes Research Institute (PCORI) fee for the first time in July 2014. Self-funded employers must pay the fee directly, but even small employers with fully insured health plans may have to pay the fee if they offer a health reimbursement arrangement (HRA). Then in fall 2014, all self-funded employers will need to report and pay the first ACA Reinsurance fee of $63 per member, per year. There are three different methodologies employers can use to calculate membership when determining fee liability. This webinar will explain the process and help employers decide which approach is best for them.

Mental Health Parity Final Regulations

The DOL, HHS and the Treasury Department have issued final rules implementing the 2008 Mental Health Parity and Addiction Equity Act (MHPAEA). These rules are designed to expand coverage of mental health and substance abuse in general, and ensure that health plan coverage is not more restrictive for mental health and substance abuse than for other medical benefits. Note that the Mental Health Parity rules generally apply to employers with at least 50 employees.

Final Wellness Plan Regulations

The Departments of Health & Human Services, Labor, and Treasury have issued final wellness program rules. The new final rules are based on the existing HIPAA wellness rules and the requirements contained in proposed rules issued in November 2012. The amount of an incentive employers can provide has been significantly increased. However, the final rules contain new requirements that make employers redesign many existing wellness programs to include “health contingent” components. Regulatory agencies will be releasing a large volume of ACA related regulations and guidance throughout 2013. One webinar each quarter of 2013 will be specifically devoted to addressing issues raised by the most recently released guidance. This webinar will not attempt to provide a broad overview of ACA rules and regulations. Rather, it will go into details regarding new developments, and new or changing regulatory guidance important to employer sponsored health plans.

Now that the IRS has released it proposed regulations and additional detailed guidance, “applicable large employers” must make sure that they have designed their benefit offerings to minimize the risk of penalties under the §4980(H) employer shared responsibility rules. This webinar will be most valuable to employers with at least 50 full time equivalent (FTE) employees. The webinar will cover details regarding employer shared responsibility rules and the various methods to define full time employees.
